TRINITY PHOTOGRAPHY Ts&Cs ~ PERSONAL SITTINGS BOOKINGS The sitting fee must be paid in full and in advance to secure your booking. If you need to rearrange your sitting date once the fee has been paid, we will do our best to find a date to suit you. You may change the date up to 3 times; we will refund your money if no suitable date can be found. If the date is changed after this you may not be eligible for a refund. If you do not rearrange your sitting and fail to arrive at the appointed time your right to a refund may be void. DELIVERY AND TIME-FRAMES We will endeavour to produce all work ordered within the following time-frames, from the date of order Prints: 10 working days Framed imagery/canvas/acrylics: 21 working days Albums: 42 working days from the sign-off of the artwork Other products: please ask for details ARCHIVING All imagery will be archived after 90 days of the date of the viewing or delivery of proof products or delivery of product ordered whichever is applicable. Retrieval of imagery at this point may incur a fee of £50. Six months after the date of archive, imagery will be deep-archived. To retrieve the work at this point will incur a fee of £50 to £100 dependant on degree of archive. This fee would go towards any product subsequently ordered so if you intend to order items worth in excess of the archive retrieval fee effectively there would be no archive fee charged. N.B. It is important to note that total loss (by the client) of commissioned work delivered to the client – i.e. replacement for lost product – is chargeable at the full rate of the cost of the original commissioned work be it in digital or hard-copy format. It is important to note that this is not the same as retrieval from archive of works that has been archived before product has been delivered (para 11-13). We advise full insurance of your chosen goods to cover any possible loss. WEB GALLERIES We will create a web gallery for you if and as required. Galleries on our website will be password-protected ONLY if requested. We will only give the password to the person who commissions the work. You are free to give the password out but please note that we will never release the password to anyone other than yourself. A condition of the web gallery is at least one functioning email address. Your gallery will usually stay live but Trinity Photography reserves the right to remove any web gallery without prior notice. If, for any reason your web gallery has had to be removed and you should wish to have it re-uploaded then we reserve the right to charge a hosting fee per calendar month for this service. If we do not hear from you the gallery will be taken offline until payment has been made. Your images will not be made live again until payment has been received. The calendar month begins when the request to have your gallery re-uploaded is received. The online gallery prices may differ from those offered in personal viewing. The images in the gallery will be of a good standard to allow reasonable viewing but will not be of printable quality. Gallery images are usually proof-marked. ~ CORPORATE SITTINGS & BOOKINGS BOOKINGS The booking fee, if applicable, must be paid in full and in advance to secure bookings. If you need to rearrange your booking date once the fee has been paid we will do our best to find a date to suit you. You may change the date up to 3 times; we will refund your money if no suitable date can be found. If the date is changed after this bookings may not be eligible for a refund. If the booking is not rearranged and the client fails to keep the appointment the right to a refund is void. We will endeavour to provide you with your digital imagery 5 - 10 working days from the date you have chosen which images are wanted. Should you require a quicker turnaround we reserve the right to charge an Express Service fee of £40. Imagery will be provided via email or 'current' digital means unless a disc is specifically ordered. Please note that once digital file(s) has/have been delivered their safe archive storage is the responsibility of the client; should there be a requirement for images to be redelivered please note the Archiving policies (above). ARCHIVING: Please refer to Archiving policies (above). ~ WEDDINGS: Wedding terms and conditions can be found separately in full on the wedding booking form. There is a reservation fee payable to secure your date. This fee is applicable at the set rates set out at time of booking. Cancellation The client may cancel this contract at any time by giving written notice to the photographer/s but in doing so shall forfeit any monies paid. Should cancellation of the wedding be received with more than six months notice prior to the date of the ceremony, your reservation fee is 50% refundable. Should cancellation of the wedding be received with less than six months and more than four months notice prior to the date of the ceremony, your reservation fee is non-refundable. Should cancellation of the wedding be received with less than one month's notice prior to the date of the ceremony 50% of fees due would be payable. Should cancellation of the wedding be received with less than two weeks' notice prior to the date of the ceremony 100% of fees due would be payable. The said sum shall be payable as compensation as an estimate of the loss the photographer/s would suffer. ~ VOUCHERS At any one time we will have vouchers for in circulation – some will be given to charities and event organisers as prizes; some will be bought as gifts for friends or family whilst some will be from external suppliers and other professional outlets. External vouchers will be supplied with their own terms and conditions which may differ from those listed here. Vouchers must be presented at time of bookings and/or at time of ordering as applicable – we reserve the right not to produce any work until proof of the voucher has been received. No vouchers have any cash value in whole or in part. Should you book your voucher sitting with Trinity Photography and fail to turn up at the appointed time we reserve the right to charge a refundable sitting fee of £49 to re-book a date. This will be returned to you once you arrive for your sitting. If you again fail to turn up you forfeit this payment. Most vouchers have an end-date and are not valid after this point. Your sitting may take place after the expiry date as long as it was booked before the expiry date. Please note that due to rising costs there may be a small donation required for anything bought after 12 months from the date of issue. Please contact us for details ~ SCRATCH CARDS: We have produced various promotional scratch cards over the past years. Please do note that some of these may or may not be valid. All cards and their winning offers may have expiry dates please call 01722 422224 for details and to ensure you are not disappointed. Winning cards related to Sittings may only be used once and only one card may be used per booking. Cards are not transferable to other services. Certain winning cards are able to be used alongside or in conjunction with other winning cards; please ask for details. More than one card may not be used at the same time. Cards can only be used towards specified products as set out on the card. Certain winning cards can only be used when booking a sitting and must be presented at time of booking. Trinity 'Delta' cards differ depending on the offer which may be running at any one time. The offer at the time of booking is that which will be honoured and can not be changed retrospectively. Therefore a Delta card used at one time may well attract a different offer to one used at a different time. Please contact Trinity Photography for details. No card may be used retrospectively. Trinity Photography reserves the right to change offers without prior notice. All card offers are subject to availability, prior appointment and booking. No cards have any cash value in whole or in part. Cards may only be used once and may not be used in a split purchase. GENERAL: Travel time and mileage expenses These are charged at a per mile rate applicable at time of booking. If in doubt please ask whether these will be charged for your commission. Reorders All reorders shall be treated as an extension of these Terms and Conditions and no responsibility for errors will be accepted unless orders are given in writing. Images All image sizes are nominal. The photographer will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials especially man-made fibres. It is sometimes impossible to record on film or in digital format the exact colour as seen by the human eye. Retouching Retouching, digital manipulation and artist finishing is available to the client as an optional extra. A certain amount of retouching is carried out as standard but this is totally at the discretion of the photographer. Additional retouching may incur additional fees. Copyright Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988. It is contrary to the Act to copy or allow to be copied photographically/electronically or by any other means an image created as part of this contract without the permission of the photographer/s in writing. Any breaking of seals in the viewing album will presume a breach of copyright. Negatives/Digital Files Negatives/digital files remain the property of the photographer. Usage-rights are provided according to the commission terms. Licence The photographer shall be granted complete artistic licence including in relation to the poses photographed and the locations used. The photographer's judgement regarding the locations/poses and number of images taken shall be final. Due to the vagaries of the weather and the willingness of subjects it may not be possible to capture all the images requested. Majeure or Act of God The due performance of these terms and conditions are subject to alteration or cancellation by either party owing to any cause beyond their control. Previews The photographer will do his best to produce as wide a variety of proofs/preview prints but there is no guarantee that any particular number of proofs/preview prints will be produced. Limitation of Liability In the unlikely event of a total photographic failure or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss. Complaints Any complaints should be raised by the client with the photographer, in writing, within 28 days of first becoming aware of the matter to be complained of and in any event within 28 days of receipt of the images.
